This privacy notice explains how Radisys Corporation and its subsidiaries and affiliates (collectively “Radisys,” “we,” “us,” “our”) collects, uses, shares, and protects personal information through our online and mobile applications, websites, and related services (collectively, the “Services”).

Some of our Services may provide you with a more specific privacy notice, in which case that more specific privacy notice overrides this one.

This privacy notice does not cover employee, former employee, or job applicant personal data processing. Please contact HR to request a copy of the employee & job applicant privacy notice.

If you do not want us to handle your personal information as described in this Privacy Notice, please do not provide us with your information or use our Services.

How We Collect Personal Information

Radisys may collect personal information about you from a variety of sources, including:

  • From you: We collect personal information you provide us either directly or through your interactions with our Services or from interactions with you before, during, or after marketing events, webinars, or trade shows. For example, we collect your information when you fill out a “Contact Us” form on our website, give us your business card at an event, or subscribe to a newsletter.
  • From your devices: The devices you use to access this website may provide information to us, including the model, operating system and version, the name of the domain from which you access the Internet, your Internet Protocol (“IP”) address, and other unique device identifiers. Radisys also collects device information like the date and time you access the Services, which pages or portions of a website you visit, the search terms you use, the links you click on, the browser you use, and your language preference.
  • From third parties & service providers: Our vendors and service providers, such as our web hosting and analytics providers, and advertisers, may provide us with information about you. For example, the host of any event you attend may give us your name and contact information. You may also give us permission to access your information from third parties, including social media networks. The information we obtain from third parties depends on your relationship with those third parties, the third parties’ privacy policies, and choices you have expressed to them regarding sharing your information.

 

Types of Personal Information Radisys Collects & Processes

Radisys may collect and process the following categories of personal information from and about you depending on the circumstances of your relationship with us:

  • Identifiers such as your name, email address, mailing address, phone number, advertising ID, and device identifiers such as MAC address and device attributes.
  • Commercial information such as the company you work for, your job title, and transaction history.
  • Contact information such as postal addresses, email addresses, social networking website user account names, telephone numbers, or other addresses at which you can receive communications.
  • Internet or other similar network and device activity such as information about your browsing behavior, search history, and other usage data; IP addresses; device identifiers; and interactions with our websites, emails, and advertisements, including data from cookies, pixel tags, and web beacons.
  • Location information such as general location and, if you provide permission, precise GPS location.
  • Inferences regarding preferences and other characteristics such as our assessment of the types of products or services you may have an interest in, language preferences from your browser, or mobile device settings.

 

How We Use the Personal Information We Collect

We may use personal information submitted to us to enable us to perform services, to respond to requests for information or feedback, to improve the quality of service we provide and to monitor the quality of our products and services, for business administration and compliance purposes, to analyze our products, services, and website, and marketing activities.

Where required by applicable law, we will obtain your consent to send you marketing communications about our products and services, offers and promotions, and invite you to events and surveys. We also target personalized marketing to potential customers for our products and services in accordance with applicable law. When we collect your business contact details through our participation at trade shows or other events, we use the information to follow-up with you regarding an event, send you information that you have requested on our products and services and, with your permission where required by applicable law, include you on our marketing information campaigns.

Where we have a contract with your enterprise as a supplier to your enterprise, we process personal information directed by your enterprise as necessary to perform our contractual relationship with you; provide our products and professional services (cloud, SaaS, maintenance, managed services); and manage our customer relationship. The processing of your information is governed by our contractual agreement(s) with your enterprise. Additionally, Radisys is a data controller when collecting and processing personal data from marketing activities such as trade shows, webinars, and campaigns.

We may also use the personal information we collect to protect Radisys against and prevent fraud, claims, and other liabilities and to comply with or enforce applicable legal requirements, industry standards, and our policies and terms. We use personal information for these purposes when it is necessary to protect, exercise or defend our legal rights, or when we are required to do so by a law that applies to us. This includes managing user accounts via identification and authentication.

If Radisys were ever to evaluate or conduct a merger, divestiture, restructuring, reorganization, dissolution, or other sales or transfer of some or all of our assets, whether as a going concern or as part of a bankruptcy, liquidation, or similar proceeding, your personal information may be among the assets transferred.

 

Purpose Limitation

Radisys will only process personal information in a way that is compatible with and relevant to the purpose for which it was collected or authorized by you, or when we notify you if the purposes change. You have the right to object to or request that we restrict the processing of your personal data for such additional purposes. You may object to a change in purposes at privacy@Radisys.com.

 

How Radisys Shares Your Data

Radisys may share your personal information among its affiliates and subsidiaries, and with others, as follows:

  • With technical service providers who perform a variety of services and functions for Radisys, such as data storage, order fulfillment, payment processing, and marketing services.
  • With courts or business partners in the event we go through a business transition such as a merger, acquisition by another company, bankruptcy, reorganization, or sale of all or a portion of Radisys’ assets.
  • With our online advertising partners, such as Meta and Google, for the purpose of advertising to you.
  • With law enforcement or governmental agencies to comply with any court order, law, or legal process, including to respond to any government or regulatory request.
  • With others where we believe a necessary and proportionate disclosure is necessary or appropriate to protect the rights, property, or safety of Radisys, our customers, or others. This includes exchanging information with other companies and organizations for the purposes of fraud prevention.
  • With unrelated third parties for their independent use upon your express authorization or direction.

 

Legal Basis for Processing

Radisys will only process your personal information when allowed by law; that is, we will only process your personal information when we have a legal basis to do so. We process personal data when one of the following legal bases applies:

  • Performance of a Contract: Where necessary to perform a contract with you or to take steps at your request before entering into a contract, such as processing a payment and fulfilling an order.
  • Legal or Regulatory Obligation: Where necessary for compliance with a legal or regulatory obligation that we are subject to.
  • Legitimate Interests: Where necessary for our legitimate interests, provided that your fundamental rights do not override such interests. We consider and balance the potential impact on you and your rights (both positive and negative) before we process your personal data for our legitimate interests. Example of processing activities based on our legitimate interest include advertising and direct marketing; improving and maintaining the Services; protecting and securing the Services and the confidential and proprietary information of customers and employees; and managing vendor relationships and services. Where Radisys relies on its legitimate interests to process your personal information, you may object to such processing at privacy@radisys.com.
  • Consent: Where you provided your consent for processing your personal data. Where Radisys relies on your consent as the legal basis for processing, you have the right to withdraw your consent at any time.

 

Third-Party Plugins & Links to Third-Party Websites

The Services contain links to external (non-Radisys-affiliated) websites. For example, if you choose, you may follow links to social media sites such as Instagram, Meta, LinkedIn, Twitter, YouTube, and others. A link to such sites does not imply Radisys endorses such sites. This Privacy Notice does not apply to those external websites. For information about their privacy practices, please review the privacy notices of these external sites.

Our Services may also offer you the ability to interact with plug-ins from social media sites, which may allow us or the social media site to receive data from or about you. If you have previously provided personal information to a third party operating a plug-in on the Services, then that third party may recognize you and link you to your behavior on the Services. Your use of social network plug-ins is subject to the privacy notice of the company that operates the plug-in, which may be different from ours, so please read these policies carefully to understand their policies and your options.

 

Your Privacy Rights

Some privacy laws, including the EU General Data Protection Regulation (“GDPR”) and California Consumer Privacy Act (“CCPA”), provide certain individual privacy and data protection rights. Depending on the location of your residence, these rights may include the right to:

  • Object to Radisys’ processing of your personal information to the processing, if we have compelling legitimate grounds for the processing which overrides your fundamental rights and freedoms as described by law.

  • Request categories of personal information we have collected or disclosed about you in the last twelve months, categories of sources of such information, our business or purpose for collecting or disclosing your information, and categories of third parties with which we shared your personal information.
  • Request a list of third parties that have received your information for direct marketing purposes during the previous calendar year.
  • Lodge a complaint with Radisys, with your privacy regulator, or a Data Protection Authority if you have concerns about our practices regarding the processing of personal data.

Our website and Services use certain cookies, pixels, beacons, log files and other technologies of which you should be aware. Your Rights to Opt-out of Personalized Advertising (i.e., Restrict Sharing or Selling Data)

Personalized advertising is a form of online advertising that aims to show ads to users based on their interests, behaviors, and preferences. Ads may appear on one of our partner platforms like Meta. Ads are personalized based on the collection and analysis of your behavior and interactions with the Radisys Services.

Radisys does not sell (as “sell” is traditionally defined) your personal information. That is, we do not provide your name, email address, or other personally identifiable information to third parties in exchange for money.

Radisys uses third-party cookies and tracking technologies, such as Meta Pixels, to identify and place advertisements targeted to users who use the Services. The California Consumer Privacy Act (“CCPA”) defines the use of such cookies and tracking technologies as “selling” and “sharing” personal data.

The CCPA and various other laws give you the right to opt-out of the selling or sharing of your personal data as well as to opt-out of targeted advertising generally. Unless you object or opt-out, this personal information is collected and analyzed to create profiles and to segment users into groups based on activities, behaviors, and demographics. Algorithms and machine learning are sometimes used to help identify patterns that let our partners and us serve you with relevant ads.

Marketing Emails & Text Messages

We send marketing materials via email and text message.

The emails and text messages we send may have tracking technologies that allow us to determine whether you have opened the messages or clicked any of the links within the messages.

You may choose not to receive marketing emails from us by following the instructions contained in any of the marketing emails we send or by changing your account settings. Please note that even if you unsubscribe from marketing email messages, we may still send you non-marketing emails.

If you no longer want to receive mobile alerts from Radisys via SMS text, you can follow the instructions provided in those messages or otherwise reply STOP to any alert we send.

 

International Transfers of Your Personal Information

At times, personal data may be transferred to service providers or systems in countries that may not offer a level of data protection equivalent to that in your country, including to and from the United States. Where such transfers occur, Radisys complies with the cross-border data transfer and export control laws of the countries in which it operates.

For personal data exports out of the European Union (“EU”) or European Economic Area (“EEA”), Radisys enters the European Commission’s Standard Contractual Clauses with the recipient to ensure compliance with the special requirements on transfers of personal data out of such countries. Where necessary, Radisys will take appropriate supplementary measures to ensure an essentially equivalent level of data protection to that guaranteed in the EEA, in accordance with European Data Protection Board ("EDPB") recommendations.

How we Safeguard Your Personal Information

Radisys will take reasonable steps to ensure that personal information is accurate, complete, current, secure, and reliable for its intended uses. We employ procedural and technological security measures that are designed to protect your personal information from loss, unauthorized access, disclosure, alteration, or destruction. However, please remember that no method of transmission over the internet or method of electronic storage is 100% secure. While we strive to use commercially acceptable means to protect your personal information, we cannot guarantee its absolute security.

How Long We Retain Your Personal Information

Radisys will keep your personal information for as long as is reasonably necessary for the purpose of the processing or as otherwise required by law. We retain personal information until it is no longer necessary for providing our products and services, fulfilling our contractual agreements with you, complying with applicable law, protecting Radisys’ rights and interests (e.g., where the retention is necessary for the establishment, exercise, or defense of legal claims), or otherwise needed for the purposes for which it was collected or processed.

Privacy Statement for Children

The Services are not intended to be directed to children that are younger than eighteen. Radisys does not knowingly collect or intend to collect personal information from children that are younger than eighteen.
